Just read the posting about staying an appeal whilst waiting for the decision of a DWP appeal, this is similar but slightly different!!!
i have an appeal where a joint DWP and fraud investigation took place. It is in relation to someone having more than 16K. The DWp part is looking at whether he has been working whilst receiving benefits. My problem is we have cancelled the claim and created an overpayment based on having over 16K but the DWP haven’t made their decision yet. Alot of our info came from them. Can i stay the appeal until we have a decision from the DWP or do i have to put forward our appeal rather than wait for them?
