Students who maintain two homes

    How do we treat a student couple’s income/applicable amount when they live separately and are eligible to claim Hb on two homes?
    Couple/family income and applicable amount on both homes?

    This gets complicated where two LA’s are invloved and in my view one of them should agree to carry out the functions of the other in these circumstances.

    This is because there should be only one claim for HB (and only one claimant), one applicable amount (the couple/family) and one application of the taper, so in other words you aggregate the two rents. (This is obviously much easier to do if only one LA is invloved)

    Unless they’re married how can you treat them as a couple? They’re just boy/girlfriend and boy/girlfriend as far as LTAHAW is concerned if they don’t live together.

    Commissioners Decision R(SB) 30/83 could be the answer to your question. If they are a couple to start with and the only reason they are living apart is because one member is going to university, then they still could be considered a couple. Even temporary abscences of quite long duration, such as attending university, does not mean they are not considered as LTAHAW.
