Under W.F.T.C/D.P.T.C a claimant could be entitled to the disability premiums if they were under 60 and in receipt of D.P.T.C.I can’t see any provisions for this under Tax Credits or am I missing something!

The latest issue of Housing Benefit direct (issue no. 14) has a list of ‘frequently asked questions’ relating to Tax Credits, and that is one of them.

Their response is that being in receipt of the [b:021bbc7ee2]disability[/b:021bbc7ee2] element of Working Tax Credit [b:021bbc7ee2]does[/b:021bbc7ee2] give entitlement to a disability premium in HB / CTB, but in the majority of cases the person concerned will also be in receipt of another qualifying benefit eg: DLA.

Can’t point you at any regulations which confirm this though!

SI2003/455 amends para 12(1)(a)(i) of HB Regs Sch 2 and para 13(1)(a)(i) of CTB Regs Sch 1 to award the Disability Premium or Higher Pensioner Premium to anyone who gets the disability element or severe disability element of Working Tax Credit.
