Temporary Absence

    Hi,

    We have a claimant who is currently in her 3rd year of study. She is studying Italian and as part of her qualification she must visit Italy for one academic year. During this year, she will return to the UK to see her children during term times and then return to Italy to finish her year there.

    Am i right in thinking that reg 7 para 16 would apply in this case and we should continue to pay Housing Benefit as she has an intention to return to the property and should not exceed 52 weeks?

    Her children are still in the property and are being looked after by a friend whilst she is away. I think we will need to look at including her as a non-dependant but for now i am unsure if we should be paying Housing Benefit at all.

    I think you should pay. The friend will only be a non-dep if she moves in permanently for the duration of the course. If she goes home when the clt returns then her normal home is elsewhere and she is not a non-dep.
