Is there a rent liability?

    3rd question already, must be one of those days!

    Property has been rented by mother (Mrs A) to her daughter(Mrs B) for several years and we have been happy to pay HB. Last June we receive a claim from Mr C who has just moved into the property. He states that he is renting one room in the house and provides a tenancy agreement between himself and Mrs A for the whole property and we agree to pay.

    We have now been told that Mrs A is selling the property and Mrs B and Mr C will be moving to another one owned by her with the same arrangements. Again Mrs B and Mr A both provide tenancy agreements for the whole property, but Mr C states that he still only has one roon. Also, Mrs B is shown as his guarantor.

    The question has been raised as to whether Mrs A can actually rent a room to Mr C when she has already agreed to let the whole property to Mrs B?

    I’m not sure you’ve typed this properly (where does Mr A come from)but I’ll have a go at what I think your question is. In a word, no, Mrs A can’t let a room to Mr C if she has already granted exclusive occupation to Mrs B. Either Mr C is the sub tenant of Mrs B or the property is now an HMO and Mrs B should be given a new tenancy agreement with, one would hope, a reduced rent to reflect the fact she can’t now use one room and has to share (presumably)kitchen and bathroom. Are Mrs B and Mr C related? Is Mr C not merely a non-dep of Mrs B?

    Thanks, yes Mr A should be Mr C which makes the situation a little clearer.

    There is no relationship between Mrs B and Mr C that we are aware of, but it does seem a little strange that he moved in within 3 months of Mrs B’s husband leaving.
