At South Oxfordshire, we have recently held an oral hearing as to whether regulation 7(1)(i) (now 9(1)(i)) breached Article 8 of the Convention of Human Rights, or Article 14, in conjunction with Article 8 or Article 1 of Protocol 1 read with Article 14.

Commissioner Powell has not delivered his judgement yet, but it should come out as CH 493 2006 shortly.

    Vix,

Commissioner Powell has given his decision in CH 493 2006. He has decided regulation 7(1)(i) is not ultra viries, does not breach Article 8, or Article 14, or Article 1 of Protocol 1 of the Convention of Human Rights. He also decided that the regulation did not discriminate against women.

I only have a hard copy, so if you still need any caselaw on this regulation, please e-mail me on James.connolly@southoxon.gov.uk so I can fax a copy to you.
