To be or not to be……… an MIS error?

    We have just checked a claim where the claimant had made a new claim in September 06 but didn’t qualify.
    We found that the rent amount had been incorrectly entered and although didn’t affect the new claim that was made in September, it did affect a previous claim that was active for a couple of weeks in April 06 which resulted in an underpayment of HB of £3.66.

    Would other LAs class this as an MIS error or not?

    Yes
    The rent used to calculate the September 06 claim was incorrect so it failed the requirement that “the whole of the decision being checked has been made with regard to and in accordance with the law.”

    it is therefore a 128 error.
