Transitional Protection for claimant on ODRT

    I have a customer who is still on ODRT regs. He has previously been in receipt of £60pw HB from 2003. however the latest ROD has come back at £55.The L/L is stating that the £60pw rent was Transitionally Protected, however i cannot find anything about this.Our LHA rate for shared room is £55pw so this would not be an option. Does anyone have any ideas??

    You would have to go back at least as far back as 1997 to find any transitional protection from previous rent assessment methods. Is it possible that this claimant’s HB could be in some way linked to those days – either in his own right or as a successor to an earlier claim by a family member? Bear in mind that people who are on IB or ESA can have quite lenghty breaks in entitlement and retain linked awards at the old rate.
