Travellers Site and Under-Occupation

    I see that site rents are exempt from the under-occupation cuts but we have a slightly different set-up at our Travellers sites.

    A few years ago we used to charge a site rent (about £40pwk) and residents pitched their own caravans. We then built chalet style 3-bedroomed dwellings on the site and residents are charged £94pwk to rent the property. Obviously the under-occ rules are causing concern as all 'chalets' were 3 bedroomed no matter what the size of h/hold and residents say they are being penalised as they never asked to be in property that was over large for some of their needs.

    I can't see anything in the draft regs that allows these type of dwellings to be exempt from the size restriction.

    Can anyone confirm if they should be exempt – and if so where in the regs I could find this?

    Sorry – i should have said that we are a scottish council and they are rent rebate cases.


    Just wanted to add that these properties come under HRA. I’ve had another look at the regs and I still think that the size criteria will apply but would be grateful if anyone can confirm that I’m reading them correctly or am I missing something dead obvious…
