    Woman leaves her local authority accommodation as a result of domestic abuse. She moves into a Woman’s Aid refuge. She immediately hands in her notice, which is one month. She therefore has a liability to pay rent on two dwellings. This liability is unavoidable.

    HB are refusing to pay two homes as they claim that there was no intention to return. I pointed out Reg 7 (6) (d) but HB are claiming that is not applicable to people fleeing violence.

    Is she entitled to ‘two homes’

    Yes, she is – the provision is Reg. 7(10).

    Yes she is entitled, there is no exclusion from 7(6)(d) for people fleeing violence.
