Under 35 in receipt of DLA care mid/high and CA paid to another party

    Hello,

    Please help, have I missed something here? Customer aged 30 in receipt of DLA care-high living in a one bed property. Currently linked to 1 bed rate LHA, anniversary date 1.4.11 – transitional benefit ends 1.1.12. Mum receives Carer’s Allowance to look after them. Will they move onto the shared room rate because they don’t qualify for SDP and they don’t have a separate room available for a carer to stay in to provide overnight care (even if it’s required)? :~

    I think your analysis is correct… mum gets CA so no SDP; no extra room so no increase in LHA rate if a ‘person requiring overnight care’. 🙁

    The key word is severe disability premium. If the single under 35 claimant does not satisfy the conditions for severe disability premium, he/she cannot be exempt from shared accommodation rate of LHA. Hence with this scenario, there wil be no shared accommodation rate exemption.

    Maybe someone should advise the mum of the situation and give her the Welfare advice she surely needs… 🙁
