Under Occupation and timing of Year End/Year Start notification letters

    Hi all,

    I've searched and can't seem to find much on the forums about this.

    In circular A4/2012 point 35 mentions that letters telling customer's about their benefit after the Under Occupation Rules have been applied, can't be issued until after 1st April, because the regulation isn't law until then.

    I'm trying to learn what other authorities are doing about this, given that we as many other LA's are about to do our year end bulc calculation, which automatically produces all the year start notification letters and CTax bills.

    Are you sending out 1 notification after bulk calc before year start with the effect of the under occ, or one before without the affect and then another one after 1st April with the affect?

    Problem we have is that our HB and now CTR notifictions and bills are combined and go out in the same envelope usually.

    Anyone any thoughts on this?

    You’ve got me thinking generally about supersessions in any case where regs, allowances etc happen and i can’t find anything. Can anyone point to the bits in the regs that say a supersession is required when the law, applicable amounts etc change?

    That was going to be my answer Chris but I tried to find something that said we could/should supersede each April when uprating happens, can’t find anything ! I can find the provision in reg 7A of the D&A regs that did specify the need for a supersession in LHA cases but can find nothing for the Social Rented sector change.

    Too late for us – we did our year end over the weekend and i just sent the notification flat file off to our external printing company, letters to be sent 17/03/2013.
