underlying entitlement

    claimant (rent ref to ro) ongoing, suspended JSI ended in march, ended and gross overpayment created, wages then received and ue applied for period of ovp and claim backdated to end of ovp period. Does the award of UE break claim meaning transfer to LHA, or as it is being backdated it is backdated to jsi end date and therfore still reffered to RO.

    To begin with I was going to transfer on to LHA, but now I am thinking that UE not an award of benefit then, I ignore this and I am really making the claim continous from jsi end date and would still have to referr to RO?

    Based on the info given, the award is not underlying entitlement. It is actual entitlement with the “ending” decision being revised to reinstate benefit, albeit at (presumably) a lower rate. As such, there is no break in entitlement.
