USA national married to UK National

    I have a USA national who came to UK on student visa in 2000, met a UK national and married and had a child and then marriage has broken down (but seems that still married). Claimant is working.

    UK Border Agency has awarded discretionary leave to remain for 3 years and letter received states that can take employment etc with no restrictions, but states nothing about Housing and Council Tax Benefit.

    Customer has stated that can claim Housing and Council Tax Benefit in line with discretionary leave policy.

    Can anyone advise if is eligible to claim HB/CTB. Thanks
