A very understanding landlord…

    Charges the LHA rate when customer not in work and thereby claiming passported benefit.  But when the tenant is in work he charges £20.00 a week less… We have evidence of this via a letter from landlord to tenant.

    My question is;  what, if anything, can/should we do ?

    If the contract is weekly then not much. If a fixed term contract then I would use the lower amount in the HB calculation.

    There is some logic behind what the landlord is doing; wear and tear will be higher when the person is not out at work. Even so, in most cases I would use the lower rent at all times.

    There could be issues about whether this is a genuine tenancy but I am guessing (and have in my mind) the type of tenancy this is.

    Thanks Peter, much appreciated. Is a 6 month contract from August so I feel the lower rent is appropriate from the start, but always worth a check.
