When is a child excluded from applicable amounts

    I have a case where the claimant has a 15 year old daughter and her child living with him. He receives CHB for his daughter and she receives CHB for her daughter. However, Claimant receives Child Tax Credit for both his daughter and granddaughter.

    Should granddaughter be included in household/family and therefore attract an applicable amount for a dependant child OR should she be excluded on grounds that Claimant does not receive CHB for her.

    This is an appeal case so I would be grateful for any ideas of how it should be treated before I fall flat on my face. Suffice to say this is an old claim and has been done in a particular way since the granddaughter was born.

    Who is responsible for the grand daughter, the mother or grandmother? I ask this because the primary carer of the child receives the applicable amount, regardless to whom CHB is paid. Hope that makes sense!
