When to make a backdate decision?

    Hi,

    Just a quickie, your opinions please

    New claim received including a backdate request.
    Adequate info supplied for backdated period but can’t determine new claim as further info required.

    Can you consider the backdate and award it even if the new claim has yet to be determined?

    What if the new claim is defective can the backdated period still be awarded?

    Thank you in advance for any advice you can give.

    Yes, I think you can pay the backdated claim.

    The “claim for Backdating” can be granted for the period for which evidence has been supplied and then suspended. If the claimant does not supply the evidence needed for the “new” claim within a month then you can end the entitlement.

    Not quite the same as making the new claim defective but the effect is much the same.
