Whose Pension?

    I am dealing with an appeal.

    What happened was………..

    We had a claim from a couple, he had a private pension and she worked. Both under 60.

    He then moved out however it appears that he continued to have his pension paid to her – it is not suggested that he is simply paying the money into her account and taking the cash.

    Is there any arguement that might be used to the effect that it’s not her money? I doubt it but I would like to know if there is one.
