worker registration scheme start date

    Cant seem to find an answer for this. Maybe you can help…

    Polish worker, started work on 21 September 2006, Worker Registration Certificate and Card both issued 28 November 2006. After 12 months uninterrupted employment, she would be treated as any other EEA national. My question is – when does the 12 months start? If its from the WRC issue date, can anyone point me in the direction of where it says this cos I cant find it. Need it for an appeal.

    Regulation 7(b) of The Accession (Immigration and Worker Registration) Regulations 2004

    (b) the worker –

    (i) during the one month period beginning on the date on which he begins working for the employer, applies for a registration certificate authorising him to work for that employer in accordance with regulation 8; and

    (ii) has not received a valid registration certificate or notice of refusal under regulation 8 in relation to that application or ceased working for that employer since the application was made;

    So if they applied for the certificate within a month of commencing employment then from the job start date, if not within the first month, from the date the certificate was received by the customer.
