    Scenario – Notification to claimant that he is entitled to WTC including disability element isent to him on 18 11 05, and first payment includes substantial arrears from 10 10 05. Arrears have been treated as capital, and disability premium has been awarded from the November date. Should he also receive the disability premium from 10 10 05?

    yes because it is the earlier date that the Working Tax Credit rules have been applied from and it is the date that these rules are applied from that triggers the disregard.
