    Please can someone help clarify how we treat class c where the proeprty becomes occupied for 4 weeks?

    e.g. 1 Jan 2008 class C awarded for 6 months to 30.6.08. If on 1.4.08 owner occupies proprty for 1 motnh and moved out on 30.4.08 what class c period is awarded from 1 May 2008? Is it to 30 June 2008 (end of original period) or is it for a further 3 months to 1.7.08? Thanks in advance.

    According to my admittedly old CPAG guide to CT any one period period not exceeding six weeks should be disregarded. Therefore I take this to mean that that class C exemption continues for the set period and it is not extended to cover for the brief period of occupation.

    Unless there has been further caselaw on that point then I suspect that this is still the same.

    Do I know what I'm doing? The jury's out on that........................

    I think Mark is right – not that it proves anything but in the example you give Northgate will automatically change the end date of the second exempt period to the same as the original six month period if the gap in between the class c’s is less than 6 weeks.

    The latest CPAG guide also implies the same…….
